2016年4月7日，贸仲委上海分会与英国大律师公会代表团共同举办的“圆桌早餐会”在沪成功召开，贸仲委上海分会代表、英国大律师公会代表团成员以及来自国内学术、实务界的法律专家共同出席了本次活动，与会人员就国际商事仲裁中的国际商事仲裁中不同的文化冲撞、道德准则以及证据提交中的特权问题(Ethics and the Clash of Legal Cultures as well as privilege in international arbitration）进行了深入的交流和讨论。
On April 7 2016, a Breakfast Roundtable successfully held by CIETAC Shanghai Sub-Commission (“CIETAC SHSC”) and the Bar Council in Shanghai. Experts from CIETAC SHSC and the Bar Council Delegation as well as domestic legal scholars and practitioners attended this roundtable. All the participants had a deep discussion regarding the issues of “ethics and the Clash of Legal Cultures as well as privilege in international commercial arbitration”.
出席本次会议的中方人员有贸仲委上海分会秘书长高菲、海仲委上海分会秘书长蒋弘、君合律师事务所合伙人刘大力和陈鲁明、汇仲律师事务所管理合伙人费宁、康达律师事务所上海分所合伙人游烔、金杜律师事务所国际合伙人MEG女士；英方人员有Chantal-Aimee Doerries QC, Chairman of the Bar Council，Delegation members, Gerard Forlin QC, Steven Thompson QC, Thomas Raphael QC, Alex Haines 和Ali Almihdar。
The Chinese participants included Ms. Fei Gao, the Secretary General of CIETAC SHSC, Ms. Hong Jiang, the Secretary-General of CMAC Shanghai Sub-Commission, Mr. Dali Liu and Mr. Luming Chen, partners from Junhe Law Firm Shanghai Office, Mr. Ning Fei, managing partner of Hui Zhong law firm, Mr. Jiong You, partner from Beijing Kangda Law Firm Shanghai Office, Ms. Meg Utterbac, an international partner from King & Wood Mallesons, Mr. Zhiqiang Zou, partner from Dentons (Shanghai) Law Office, Mr. Zhensheng Chen, partner from Polaw & co. Shanghai, Mr. Chenyang Zhang, Deputy Secretary-General of Shanghai Pudong Sub-Commission of CCPIT. The five delegation members from British are: Ms. Chantal-Aimee Doerries, QC and the Chairman of the Bar Council, Gerard Forlin QC, Steven Thompson QC, Thomas Raphael QC, Alex Haines and Ali Almihdar.
高菲秘书长和蒋弘秘书长分别就贸仲委上海分会和海仲委上海分会情况进行了介绍；英国大律师公会主席Chantal-Aimee Doerries QC对律师公会的工作尤其是对中国律师的培训和与贸仲的合作作了介绍；Steven Thompson先生和Thomas Raphael先生作为主持人，就国际商事仲裁中的道德准则和特权问题与与会嘉宾进行了交流；费宁、游炯、MEG和陈鲁明律师分别就国际商事仲裁中普通法系和大陆法系举证责任的异同、从仲裁庭和律师的不同角度如何应对仲裁程序的拖延、专家证人和证据、国际商事仲裁中的道德准则、中国法律有关“特权”问题的规定作了交流，其中，中英双方不断地就有关问题随时发表、交流自己的看法和意见。
Ms. Fei Gao and Ms. Hong Jiang respectively introduced the current development of CIETAC SHSC and CMAC SHSC. Chantal-Aimee Doerries QC, the Chairman of the Bar Council, introduced the work of the Bar Council especially the cooperation with CIETAC and the training program for Chinese lawyers. As the moderators of the roundtable, Mr. Steven Thompson and Mr. Thomas Raphael respectively and actively exchanged the ideas and discussed issues of ethics and privilege in international commercial arbitration. During the discussion, Ning Fei, Jiong You, Meg Utterback and Luming Chen put forward their opinions on the differences of burden of proof between civil law and common law systems, response to delaying tactics from the different perspectives of arbitral tribunal and lawyers, expert witness and evidence, ethical issues in international commercial arbitration and “privilege” in Chinese law. During the whole discussion, both sides actively presented and exchanged their own ideas and opinions.
早餐会后，参加本次早餐会的中方人员继续就如何进一步开拓发展贸仲委上海分会的工作进行了讨论。
After the Roundtable, all the Chinese participants left to discuss continuously how to make a further promotion and development of the work of CIETAC SHSC.
